Service provider These Terms & Conditions (“Terms”) govern the services offered on this website. The services are provided by: **Mykyta Severyn W-D-M** ul. In these Terms it is referred to as the “Provider”, “we” or “us”. The person or company ordering services is the “Client”. ## 2\. Services The Provider offers web development services, including WordPress website development, custom theme and plugin development, Bricks, Oxygen and Elementor builds, Astro website development, API integrations and automations, technical audits and ongoing support. Descriptions and typical price ranges are published on the [Services](https://w-d-m.com/services) and [Pricing](https://w-d-m.com/pricing) pages. We do not sell physical goods, and we do not build online stores or payment-processing systems. ## 3\. How to order 1. The Client submits a request through the [contact form](https://w-d-m.com/contact), by email or during a booked call. 2. The Provider replies with a written quote describing the scope, deliverables, timeline, price and payment schedule. 3. The contract is concluded when the Client accepts the quote in writing (email is sufficient). Submitting a request or booking a call is free and does not create any obligation for the Client. ## 4\. Prices and payment - Prices on the website are indicative ranges in EUR. The binding price is the one stated in the accepted quote. - Prices are net; VAT is added where required by law. - The payment schedule is agreed in the quote. Available options: - **50/50** — 50% before work starts and 50% on completion; - **20/80** — 20% before work starts and 80% on completion; - **33/33/33** — three equal instalments: before work starts, at an agreed milestone and on completion; - **weekly hourly billing** — an invoice every Friday for the hours worked during the current week. - With instalment schedules, work starts after the first instalment is paid, and the final instalment is due before final handover of files and access. - Services priced per hour are billed at the hourly rate stated on the Pricing page, based on an estimate approved by the Client in advance. - Payment is made against an invoice by bank transfer or by debit/credit card via a secure payment link. Card details are processed by the payment provider and are never stored by us. - Invoices are payable within 7 days unless stated otherwise. ## 5\. Timeline and Client cooperation The timeline in the quote assumes the Client provides content, feedback and access (hosting, domain, accounts) on time. Delays on the Client’s side extend the timeline accordingly. Each quote includes up to two rounds of revisions per milestone; additional changes outside the agreed scope are quoted separately. ## 6\. Acceptance and handover When a milestone or the project is complete, the Provider shares it for review. The Client has 7 days to report non-conformities with the agreed scope. If no issues are reported within that time, or the Client starts using the work in production, the work is considered accepted. ## 7\. Warranty and support For 30 days after handover the Provider fixes, free of charge, any defects that cause the work to deviate from the agreed scope. This does not cover changes made by the Client or third parties, plugin or WordPress core updates released after handover, or hosting issues. ## 8\. Intellectual property After full payment, the Client receives ownership of the custom code and design files created specifically for the project, together with the right to use, modify and publish them. Third-party components (WordPress, open-source libraries, premium plugins, fonts, stock images) remain subject to their own licences. The Provider may show the completed project in its portfolio unless the Client objects in writing. ## 9\. Cancellation and refunds The Client may cancel the order at any time. Refunds and cancellations are governed by our [Refund & Cancellation Policy](https://w-d-m.com/refund-policy), which forms part of these Terms. ## 10\. Consumers If the Client is a consumer (or a sole trader for whom the contract has no professional character), they have additional rights under the Polish Consumer Rights Act of 30 May 2014, including the 14-day right of withdrawal described in the [Refund & Cancellation Policy](https://w-d-m.com/refund-policy). Nothing in these Terms limits mandatory consumer rights. ## 11\. Liability The Provider’s total liability under a contract is limited to the amount paid by the Client for that contract. The Provider is not liable for indirect losses, lost profits or data loss caused by hosting providers, third-party services or the Client’s actions. This limitation does not apply to consumers to the extent prohibited by law, or to damage caused intentionally. ## 12\. Complaints Complaints can be sent to [info@w-d-m.com](mailto:info@w-d-m.com) . Please describe the issue and the related order. We respond within 14 days. ## 13\. Personal data Personal data is processed in accordance with our [Privacy Policy](https://w-d-m.com/privacy-policy). ## 14\. Governing law and disputes These Terms are governed by Polish law. Disputes with business clients are resolved by the court competent for the Provider’s registered address. Consumers may bring claims before the court competent under general rules and may use out-of-court dispute resolution, for example through the municipal consumer ombudsman. ## 15\.
